1. Introduction and acceptance
1.1 These Terms of Service ("Terms") govern your use of the Baseline Tennis Academy booking application and any associated website or admin-facing services (together, the "Platform"), operated by Baseline Tennis Academy ("the Academy", "we", "us", "our"), of 40 Bargate Road, Harare, Zimbabwe.
1.2 By creating an account you agree to these Terms and to our Privacy Policy. When you create an account the Platform presents the statement "By creating an account you agree to the Terms of Service and Privacy Policy", and both documents are also available from the in-app Help & Support area and on our website.
1.3 If you do not agree to these Terms, do not create an account or use the Platform.
1.4 These Terms apply to every person who uses the Platform, whether you are a parent or guardian booking on behalf of a child member or an adult who plays and books for yourself.
2. What the Platform does
2.1 The Platform lets you create an account and book places in the Academy's group classes, school programmes, camps, tournaments, private coaching and court hire.
2.2 The Platform is a booking and scheduling tool only. It does not take payment. It stores no card, price-paid or other payment information. Payment for Academy activities is arranged separately and offline, directly with the Academy, in accordance with the Academy's own payment terms (see section 6).
3. Account eligibility
3.1 To create and hold an account you must be at least 18 years old.
3.2 Children do not hold their own accounts and cannot log in. A parent or guardian holds the account and manages the child members within it.
3.3 You confirm that the information you give when creating your account is accurate and that you will keep it up to date.
3.4 You are responsible for keeping your login credentials confidential and for all activity that takes place under your account. Tell us promptly at simon@bta.co.zw if you believe your account has been accessed without your authority.
4. Family accounts and managing children ("members")
4.1 Your account is a family account. As the account holder you may add one or more "members" — the people you book for. Members may be children in your care or, where you are an adult player, yourself.
4.2 For each member you may provide the member's name, date of birth, playing level, school attended and related details used to place the member in age-appropriate and level-appropriate activities and to build class rosters.
4.3 You create, edit and remove member records. Members have no separate login. By adding a child as a member and managing that child's record, you confirm that you are the child's parent or legal guardian and that you consent, on the child's behalf, to the Academy processing the child's information for the purposes described in these Terms and in the Privacy Policy.
4.4 You are responsible for the accuracy of the member information you enter and for ensuring you have the authority to provide it.
5. Bookings and cancellations
5.1 You may book members into available activities through the Platform. A booking is confirmed subject to available capacity at the time it is made.
5.2 Cancellation — 24-hour rule. You may cancel a member's place in an activity yourself through the Platform provided you do so at least 24 hours before the activity starts. When you cancel in time, the place is released and becomes available to others.
5.3 Within 24 hours of the activity, self-service cancellation is not available through the Platform. To cancel or discuss a place inside the 24-hour window you must contact the Academy directly. The Platform will show you a message directing you to contact the club.
5.4 The 24-hour rule described above reflects exactly how the Platform is built. Any commercial consequences of a cancellation (for example whether a session is charged or credited) are governed by the Academy's separate payment terms, not by the Platform.
6. Payment (offline)
6.1 The Platform does not process payments and holds no payment information.
6.2 Fees for classes, programmes, camps, coaching and court hire are set, invoiced and collected by the Academy offline, in accordance with the Academy's own payment, cancellation, refund and credit terms.
6.3 Nothing in these Terms creates any refund or credit entitlement. Refunds and credits, if any, are dealt with solely under the Academy's separate payment terms.
7. Assumption of risk, waiver and medical authorisation
7.1 Physical activity carries risk. Tennis coaching, play, fitness activity and related use of the Academy's courts and facilities involve inherent risks of injury. By using the Platform to book activities, and by attending those activities, you acknowledge and accept those risks on your own behalf and on behalf of each member you book.
7.2 Assumption of risk and waiver. To the fullest extent permitted by the law of Zimbabwe, you voluntarily assume the risks of participation and agree that neither you nor any member will hold the Academy, its staff, coaches or contractors liable for injury, loss or damage arising from participation, except to the extent such injury, loss or damage is caused by the Academy's gross negligence or wilful misconduct, or where liability cannot lawfully be excluded.
7.3 Medical-emergency authorisation. If a participant (including a child member) suffers injury or a medical emergency during an activity and you or the child's parent or guardian cannot be reached in time, you authorise the Academy's staff to arrange or consent to such emergency first aid, medical treatment or transport as a responsible person would reasonably arrange in the circumstances. You remain responsible for any costs of such treatment or transport under the Academy's separate terms.
7.4 The Platform does not currently collect medical, allergy, health or emergency-contact information. You remain responsible for informing the Academy directly of any medical condition, allergy or other information relevant to a participant's safe participation.
8. Acceptable use
8.1 You agree to use the Platform only for lawful purposes and only to make and manage genuine bookings for yourself and for members in your care.
8.2 You must not:
- attempt to access, book for, or view the records of any family or account other than your own;
- attempt to gain unauthorised access to the Platform, its accounts, its data or its underlying systems;
- interfere with, disrupt, probe or overload the Platform or its infrastructure;
- upload or transmit unlawful, abusive or malicious content; or
- use the Platform to harass Academy staff, coaches or other users.
8.3 The Platform is designed so that each account can see and manage only its own family's information. Attempting to circumvent that design is a breach of these Terms.
9. Availability and changes to the Platform
9.1 We aim to keep the Platform available but do not guarantee uninterrupted or error-free operation. The Platform may be unavailable during maintenance or because of factors outside our control.
9.2 We may add, change or remove features of the Platform, including activities offered for booking, at any time.
10. Suspension and termination
10.1 You may stop using the Platform at any time and may delete your account from within the app. Account deletion is immediate and irreversible, and is described in the Privacy Policy. In summary, your identifying information and that of your members is removed, future bookings are cancelled so the places are released, and past booking records are kept in anonymised form so that historical rosters remain accurate.
10.2 We may suspend or terminate your access to the Platform if you breach these Terms, if we reasonably suspect unauthorised or unlawful use, or if we are required to do so by law.
10.3 Termination does not affect rights or obligations that arose before termination. Provisions that by their nature should survive termination — including sections 7 (assumption of risk and waiver), 11 (liability), 13 (governing law) and any accrued obligations — survive.
11. Limitation of liability
11.1 The Platform is provided on an "as is" and "as available" basis. To the fullest extent permitted by the law of Zimbabwe, we exclude implied warranties about the Platform's availability, fitness for a particular purpose or freedom from error.
11.2 To the fullest extent permitted by the law of Zimbabwe, and subject to section 11.3, the Academy is not liable for indirect or consequential loss, or for loss arising from your failure to keep your account credentials secure or from information you or your members entered incorrectly.
11.3 Nothing in these Terms limits or excludes any liability that cannot lawfully be limited or excluded under the law of Zimbabwe, including liability for death or personal injury caused by negligence to the extent the law does not allow it to be excluded, for fraud, or any statutory consumer protection that applies to the Academy's dealings with you. The limits in this section are intended to operate only to the extent Zimbabwean law and fair consumer practice allow.
12. Privacy
12.1 Our handling of personal information — including the information you and your members provide, how long it is kept, and how account deletion works — is described in the Privacy Policy, which forms part of your agreement with us. The Privacy Policy is written with reference to Zimbabwe's Cyber and Data Protection Act [Chapter 12:07].
13. Governing law and jurisdiction
13.1 These Terms, and any dispute or claim arising out of or in connection with them or their subject matter, are governed by the law of Zimbabwe.
13.2 The courts of Zimbabwe have jurisdiction to settle any such dispute or claim. Disputes are dealt with through the courts, not by arbitration.
14. Changes to these Terms
14.1 We may update these Terms from time to time, for example to reflect changes to the Platform or to legal requirements.
14.2 When we make a material change we will make the updated Terms available in the app and on our website and update the date shown at the top. Your continued use of the Platform after an updated version takes effect means you accept the updated Terms. If you do not accept them, you should stop using the Platform and may delete your account.
